Frequently asked questions
- Yes, if the restaurant operates a wood-fired oven, tandoor or has diesel-genset above 125 kVA. Such restaurants fall under the Orange or Green category and require Consent to Operate from J&K PCC. AC-only restaurants without combustion sources may be exempt.
- Consent to Establish (CTE) is the pre-construction approval issued before setting up the unit. Consent to Operate (CTO) is the post-commissioning approval issued after pollution control equipment is installed and tested, allowing actual operations.
- Industries are classified into four categories based on the Pollution Index (PI) defined by CPCB: Red (PI ≥ 60), Orange (41 ≤ PI < 60), Green (21 ≤ PI < 41) and White (PI < 21). White category units are exempt from consent but must intimate JKPCC.
- CTO validity depends on category: 5 years for Red, 10 years for Orange and 15 years for Green industries. Renewal applications must be filed at least 120 days before expiry to avoid penalty.
