Trademark Registration

A trademark is a distinctive sign — word, logo, slogan, colour or shape — that identifies the goods or services of one business and distinguishes them from others. Trademark registration in India is granted by the Controller General of Patents, Designs & Trade Marks under the Trade Marks Act, 1999, and gives the owner exclusive nationwide rights for 10 years (renewable indefinitely).

Shop Act License

Shop Act registration — formally the Shops & Establishment registration — is a mandatory licence issued by the J&K Labour Department under the Shops and Establishments Act to every commercial establishment, including shops, offices, godowns, restaurants, theatres and other places of public amusement. It regulates working hours, holidays, leave and conditions of employment.

All Labour Licenses

Labour and Professional Tax registrations are the statutory employer registrations that an establishment must obtain after hiring its first set of employees — primarily EPFO (Provident Fund) once 20 employees are crossed, ESIC (Employees' State Insurance) once 10 employees are crossed (wages ≤ ₹21,000/month), and the J&K Building & Other Construction Workers (BOCW) cess for construction projects. Professional Tax is not levied in J&K, but applies to employers with branches in PT-levying states such as Maharashtra, Karnataka and West Bengal.

Pollution Control License

Pollution NOC consists of two consents issued by the J&K Pollution Control Committee (JKPCC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. 'Consent to Establish' (CTE) is required before setting up an industry or commercial unit, and 'Consent to Operate' (CTO) is required before commencing operations. Industries are classified as Red, Orange, Green or White based on their pollution potential.
