The Jammu & Kashmir Pollution Control Committee (JKPCC) issues environmental consents under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. Two consents are involved: Consent to Establish (CTE) — needed before you set up the unit — and Consent to Operate (CTO) — needed before commercial operations begin.
This guide explains how the CPCB pollution-load category framework (Red, Orange, Green, White) applies in J&K, what documents JKPCC needs, fee slabs and the typical timeline.
Pollution categories — Red, Orange, Green, White
Every industrial or commercial activity is mapped to one of four categories by the Central Pollution Control Board, based on its pollution potential. JKPCC follows the same categorisation.
- Red — high pollution potential. Includes tanneries, distilleries, cement plants, large pharma, hot-mix plants, slaughterhouses. Requires CTE + CTO + frequent renewals.
- Orange — moderate. Includes hotels above 20 rooms, restaurants above 100 covers, automobile servicing, small pharma, brick kilns, food processing units. CTE + CTO required.
- Green — low. Includes small manufacturing, packaging, biscuit/snack units, cold storage, IT data centres above 20 racks. Auto-renewal scheme available.
- White — minimal. Includes coaching centres, retail offices, IT software companies. Simplified online consent or self-declaration.
Documents required for CTE / CTO
Submit applications via the JKPCC online portal (jkpcb.nic.in). Document set varies by category but typically includes:
- Application form duly filled (Form-I for CTE, Form-II for CTO)
- Project report or DPR with raw materials, products and processes
- Site plan and layout of effluent treatment plant (ETP) where applicable
- Land ownership/lease document
- NOC from local body / panchayat
- Water consumption and effluent generation calculation
- Fuel consumption and air emission calculation (chimney heights, scrubbers)
- Hazardous waste generation details (for Red/Orange manufacturers)
- Solid waste management plan
- Environmental Clearance from MoEF (only for Schedule-I projects)
- Bank draft for consent fee
Step-by-step process at JKPCC
JKPCC has fully digitised its consent process. Applications are tracked on jkpcb.nic.in with SMS/email status updates.
- 1. Determine category from CPCB master list
- 2. Register on jkpcb.nic.in with PAN and mobile
- 3. File CTE application before construction starts — upload all documents and pay fees
- 4. JKPCC scrutinises (within 30 days) and may seek clarifications
- 5. CTE issued — typically valid for 5 years or till commissioning
- 6. After installation of pollution control equipment, file CTO application
- 7. JKPCC inspection of ETP/scrubbers/stack/effluent quality
- 8. CTO issued — validity 1–5 years depending on category
- 9. Renewal must be filed at least 60 days before expiry
Consent fees in J&K (2025)
JKPCC fees are based on Capital Investment (gross block) of the unit. As of 2025, indicative slabs:
- Up to ₹10 lakh: ₹1,500 per consent
- ₹10 lakh – ₹1 crore: ₹3,000 – ₹15,000
- ₹1 crore – ₹10 crore: ₹15,000 – ₹50,000
- ₹10 crore – ₹50 crore: ₹75,000 – ₹2 lakh
- Above ₹50 crore: ₹2 lakh – ₹15 lakh
- Hazardous Waste Authorisation: additional ₹5,000 – ₹50,000
- E-Waste / Plastic Waste / Bio-medical Waste authorisations: separate fee scales
Allied authorisations under JKPCC
Beyond CTE/CTO, JKPCC also issues several waste-management authorisations. These are mandatory for specific business types and are processed alongside the CTO.
